These terms govern your use of the Mohamed Reda website and any inquiry, booking, consulting, media buying, creative, automation, or digital marketing services offered through it.

These terms are interpreted in accordance with the laws and regulations applicable in the State of Kuwait, including mandatory rules relating to electronic transactions, cybercrime, evidence, and consumer protection where applicable.

1. Website Use
You may browse this website for lawful personal or business purposes. You agree not to misuse the website, attempt unauthorized access, interfere with its operation, publish unlawful content through contact forms, or use the website in any manner that may violate Kuwaiti law, public order, or the rights of others.
You remain responsible for the accuracy of the information you submit when requesting a quote, consultation, audit, or project engagement.
2. Nature of Services
The website presents professional services that may include strategy, media buying, creative direction, branding, content writing, automation, consulting, training, and related digital deliverables. A website visit or inquiry alone does not create a binding client relationship.
A project becomes binding only after written approval of a quotation, proposal, statement of work, invoice, or another written confirmation accepted by both parties, whether by email, electronic signature, or a documented electronic communication method recognized under applicable Kuwaiti electronic transactions rules.
3. Fees, Payment, and Taxes
Fees, milestones, payment methods, timelines, and scope are determined in the relevant proposal or invoice. Unless otherwise stated in writing, quoted amounts are exclusive of third-party platform fees, media spend, app subscriptions, domain or hosting charges, payment gateway fees, and any governmental fees or taxes that may become applicable.
Work may be paused if payment is overdue. Deliverables, account transfers, launch files, or final exports may be withheld until outstanding amounts are settled in full.
Any mandatory customer rights under applicable Kuwaiti consumer protection rules remain unaffected where those rules legally apply to the engagement.
4. Client Responsibilities
Clients must provide timely approvals, accurate business information, legal rights to use supplied materials, and access credentials required for execution. The client confirms that any logos, media, databases, brand assets, accounts, or content they provide may be lawfully used for the project.
The client is responsible for the legality of their products, offers, claims, landing pages, business licensing status, and regulated-sector compliance, including sectors such as finance, healthcare, education, or advertising where additional approvals may be required in Kuwait or the target market.
5. Intellectual Property
Unless otherwise agreed in writing, all pre-existing know-how, templates, methods, prompts, workflows, internal systems, strategy frameworks, and non-client-specific tools remain the property of Mohamed Reda.
Ownership of final approved deliverables prepared specifically for the client transfers only after full payment of all related invoices. Raw files, drafts, rejected concepts, source prompts, internal documentation, and reusable systems are not automatically transferred unless expressly included in the written scope.
The website content, branding, articles, graphics, and text may not be copied, republished, or commercially reused without prior written permission, except where a law of the State of Kuwait permits otherwise.
6. Confidentiality and Data Access
Any non-public business information shared during a project will be treated as confidential and used only to perform the agreed services, except where disclosure is required by law, regulation, court order, or a competent authority in Kuwait.
If account access is provided for advertising, analytics, CRM, automation, or website management, reasonable measures will be taken to use that access only for the engagement scope. Clients should revoke access after project closure where continued access is no longer required.
7. Performance Disclaimer
Marketing, advertising, and automation services involve variables outside direct control, including budget, competition, product quality, pricing, market conditions, seasonality, and platform policy changes. Therefore, no guarantee is made regarding revenue, lead volume, approval rates, ranking position, or campaign profitability unless expressly stated in a signed written agreement.
Any figures, projections, case studies, or examples on the website are illustrative and do not constitute a binding promise of identical results.
8. Third-Party Platforms
Projects may involve third-party services such as Meta, Google, TikTok, hosting providers, CRM tools, analytics providers, automation platforms, AI tools, or payment processors. Their own terms, policies, service levels, and account enforcement decisions apply independently.
Mohamed Reda is not responsible for suspension, rejection, downtime, data loss, policy enforcement, or technical restrictions caused by third-party platforms, except to the extent resulting directly from proven willful misconduct or gross negligence.
9. Cancellation, Suspension, and Termination
Either party may terminate a future or ongoing engagement according to the notice and payment terms stated in the relevant proposal. Fees already earned, work already performed, committed production costs, and non-cancellable third-party charges remain payable.
Access may be suspended immediately where there is abusive conduct, unlawful use, non-payment, reputational risk, fraudulent activity, or a reasonable belief that continuing the engagement could violate law or platform policies.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Mohamed Reda shall not be liable for indirect, incidental, special, consequential, reputational, or loss-of-profit damages arising from website use or service engagement.
Where liability is legally established, total liability for a specific engagement shall generally be limited to the amount actually paid by the client for that engagement during the three months preceding the event giving rise to the claim, unless a written contract provides otherwise or mandatory law in Kuwait requires a different result.
11. Governing Law and Disputes
These terms and any dispute relating to the website or services shall be governed by the laws of the State of Kuwait, without prejudice to any mandatory legal protections that cannot be waived.
The parties will first attempt to resolve disputes amicably in good faith. If no resolution is reached, the competent courts of the State of Kuwait shall have jurisdiction unless another competent forum is required by a mandatory legal rule or a separately signed agreement.
